Terms of Service
These terms use decision branches. Read the section that matches the action you are taking, then follow the conditions and exceptions before relying on a particular outcome.
Using this website and accepting the terms
If you use this website, then you agree to follow these terms and any policy linked from the checkout. If you do not accept a condition, then do not place an order or continue using the account features.
When you browse or purchase, then you must provide accurate information and use the site lawfully. When an automated tool is used to scrape, probe, overload, or interfere with the service, then access may be restricted and affected orders may be cancelled.
If maintenance or security work interrupts the site, then service may be unavailable for a period. When an interruption affects an order already placed, then we contact the customer rather than leaving the order in an unexplained state.
When credentials are issued to you, then keep them confidential and report suspected misuse to [email protected]. If another person uses your credentials, then you remain responsible for activity performed through that access unless the misuse resulted from our failure.
Order acceptance and stock checks
When an order is submitted, then it is an offer to buy rather than an accepted contract. If stock is available and payment clears verification, then the order is accepted for fulfillment. If an item sells out, then the order or affected line may be cancelled.
When payment cannot be verified or the delivery details are incomplete, then the order may be held or declined. When cancellation follows a completed payment, then the amount paid for the cancelled item is refunded and the reason is explained.
If an order appears fraudulent, then it may be cancelled before dispatch even when payment has been authorized. When a customer orders repeatedly without intending to pay, then future orders may require another payment method or additional verification.
When an amendment is requested before dispatch, then it is handled only after written confirmation. If the amendment changes the price, tax, delivery cost, or available stock, then the difference is settled before the revised order proceeds.
Price and payment when checkout changes
If a price is displayed on the site, then it may change before an order is confirmed. When the order summary is accepted, then the price, tax, and shipping charge shown on that summary apply to the order.
When payment is submitted, then it is handled through Stripe, which is certified to PCI-DSS Level 1. If a card is used, then Visa, Mastercard, American Express, and Discover are accepted. When PayPal is used, then authorization occurs on PayPal's site.
If a pricing error is caused by a technical fault, then the order may be paused while the correct amount is verified. When the corrected price is higher, then the customer may approve the difference or cancel the order for a refund.
When a payment is declined, then no completed charge is created and the order remains unpaid. If a bank places a pending authorization, then the hold is released by the bank under its own timeline.
Delivery, risk and carrier handoff
When a delivery estimate is shown, then it is an estimate rather than a guaranteed date. If a parcel is delayed by weather, carrier disruption, an incomplete address, or a failed delivery attempt, then the revised timing depends on the carrier route.
When a parcel leaves our premises, then risk passes on delivery unless the law provides otherwise. If a parcel is lost or damaged in transit, then we open the carrier claim and offer a replacement or refund once the claim is resolved.
If the address is incorrect, then contact us before the first carrier scan for the best chance of correction. When the parcel has already moved, then a redirect may not be possible and a second dispatch after return may be charged to the customer.
When a carrier offers a collection point or delivery window, then that arrangement sits between the customer and the carrier once the parcel is in its network. If nobody collects the parcel, then a return or second dispatch follows the carrier rules.
Returns and refunds: the operative path
If a return or refund is requested, then the Return Policy forms part of these terms and governs the item condition, return window, carriage, inspection, and refund timing. When an item is eligible, then it may be returned within 30 days of delivery.
When a refund is approved, then it is issued within seven calendar days to the original payment method. If the original card or PayPal account cannot receive the refund, then the available alternative is explained after the payment record is checked.
If a return arrives late or outside eligibility, then it may be refused, held for instructions, or returned to the customer at the customer's cost. When the fault is ours, then the relevant carriage and remedy follow the error rather than the change-of-mind path.
Opened packs, used items and anything that has been outdoors for a season cannot be returned, because the condition cannot be reversed.
Items with missing parts, fixings or instructions cannot be accepted as unused.
Anything marked final sale on its own page is outside the return policy, and the marking is shown before checkout.
Products returned without their original packaging may still be accepted, but a partial refund may apply.
When a dispute concerns both these terms and the Return Policy, then the more specific return rule controls the return question while these terms continue to govern the wider contract.
Care, safety and published instructions
If product care, safety, assembly, or use is considered, then the label, product page, and supplied instructions are part of the information on which the item is sold. When those sources differ, then follow the more protective instruction and contact us before using the product.
Midwinter Green lists the size, material and the conditions each item was designed for on the product page, and those notes should be treated as the working limits. Anything electrical or load-bearing should be checked before first use, and anything that has been outdoors should be dried fully before it is put away.
When damage results from misuse, alteration, ignored instructions, or use with an incompatible product, then the return policy may not cover the item. If the product fails during normal use, then provide photographs, the order reference, and the conditions in which the failure occurred.
If a manufacturer warranty is supplied, then it runs alongside these terms rather than replacing them. When a warranty claim is made, then the manufacturer or its service process may control the inspection and remedy for that claim.
When a product is intended for use with another item, then confirm compatibility before applying it. If the result appears unsafe or inconsistent with the label, then stop using it and contact [email protected] with photographs and the batch details.
Intellectual property and permitted use
When intellectual property or content rights are involved, then the site text, photographs, graphics, layout, product descriptions, and the Midwinter Green name are owned by us or used under permission. If no written licence is granted, then those materials may not be copied, resold, or presented as another business's work.
When a customer links to a product page or quotes a short extract in a review, then that use is normally permitted. If a larger reproduction is wanted, then request written permission before publishing it.
When a third-party mark appears on the site, then it remains the property of its owner and no licence is granted by its appearance. If a message suggests that another business endorses or operates this site, then that impression must not be created without authorization.
When a copyright complaint is received, then the material may be removed while the claim is reviewed. If the complaint is resolved in favor of the content, then it may be restored.
Conduct breaches and account limits
If conduct breaches the ordering rules, then we may cancel an order, suspend an account, or restrict access. When a payment instrument is used without authority, then the matter may be reported to the payment processor and the relevant authorities.
When a customer submits false information, threatens staff, or uses the returns process as a borrowing arrangement, then future orders may require additional verification. If the issue is resolved, then the restriction may be lifted.
When a security test is proposed, then written authorization is required before any probing or scanning. If an automated process places orders without disclosure, then those orders may be cancelled and the source may be blocked.
When a breach affects another customer, then access may remain restricted until the risk is contained. If information is needed to resolve the issue, then the request will identify the specific conduct under review.
When a restriction is applied, then the customer is told which conduct caused it and what may resolve the issue.
Liability, direct loss and excluded loss
If liability is assessed, then we are responsible for foreseeable direct loss caused by our breach or negligence to the extent the law requires. When a claim concerns an order, then the amount paid for that order is the usual limit on our liability.
When indirect or consequential loss is claimed, then it is excluded where the law permits. If the loss concerns lost profit, lost opportunity, or a delay caused by a carrier or event outside our control, then the claim may fall outside the recoverable branch.
When death, personal injury, fraud, or a non-excludable consumer right is involved, then nothing in these terms limits the responsibility or protection that the law provides.
When a product causes property damage, then the outcome depends on how it was used, the care instructions, and any manufacturer warranty. If a claim is valid, then the evidence and remedy path are explained before a decision is made.
Changes, updates and the version in force
When these terms change or receive an update, then the revised version is published on this page with a new effective date. If a change is material, then the reason for the change is described in plain language.
When an order has already been placed, then a later update does not retroactively change the terms that applied when the order was accepted. If a legal change requires immediate application, then it applies from the date required by law.
When an earlier version is needed, then it is retained and may be requested from [email protected]. If a customer continues to use the site after an update, then the current version applies to that continued use.
When a change affects returns, refunds, payment, or liability, then the revised wording is reviewed for clarity before publication. If the change reduces a customer right, then the updated text identifies the reduction rather than leaving it to be inferred.
Law, jurisdiction and dispute steps
If law, jurisdiction, or a dispute applies, then these terms are governed by the law of the United States and the state in which the business is established. When consumer protections in the customer's location provide greater rights, then those protections continue to apply.
When a dispute begins, then write to [email protected] with the order reference and a description of the issue. If the matter can be resolved through correspondence, then no formal step is needed.
When correspondence does not resolve the issue, then the parties may agree to mediation before proceedings are issued. If mediation is not suitable, then either party may use a court or consumer process available under the applicable law.
When a claim is brought in a small-claims process, then that route remains available if it meets the relevant threshold. If a mandatory local rule applies, then it overrides a conflicting term to the extent required.
When a local consumer rule gives a different forum, then that rule may determine where the dispute is heard.
Contact and order references
When you contact us about these terms, then write to [email protected] and include the order reference if the question concerns a purchase. If the matter is legal, then mark the message clearly so it reaches the correct review path.
When a message raises several issues, then list them separately so each point receives a direct answer. If a document or photograph is relevant, then attach it rather than describing it from memory.
When a response is required within a certain period, then state the deadline and the reason for it. If the request concerns a consumer right, then the statutory deadline continues to apply even when no reminder is sent.
When a complaint or data request is received, then it is logged and answered in writing. If the first reply does not resolve the issue, then the customer may ask for a second review.
If the mailbox is unavailable, then use the same address again after a short interval.
